The WINNER Program (the “Program”) is a program owned and managed by Nine Destiny Metaphysics Sdn Bhd (the “Company”).
By applying for participation in the Program, you hereby AGREE to be bounded by the following terms and conditions.
- Disclaimer
* The Company has not promised, shall not be obligated to and will not; (1) procure or attempt to procure employment or business or sales for Members; (2) perform any business management functions including but not limited to, accounting, tax or investment consulting, or advice with regard thereto; (3) act as a therapist providing psychological counseling or behavioral therapy; (4) introduce Members to Company’s full network of contacts, media partners or business partners. - Eligibility
* The program is only open to members who have completed the membership registration and made full payment to the Company.
* Membership application is open to individuals who are aged 18 years and above.
* Upon application for membership, the company will conduct a short interview to further understand if you are suitable for the program.
* The Company reserves the right to refuse application of the Program to anyone who, in our best judgement, will not benefit from the experience of the Program at this time - Payment
* Any payment made to the company after the interview session is non refundable.
* Payment or deposit is needed within 7days upon notification of the interview result.
* Deposit is valid for 60days to secure the limited time offer, should there be no further payment update after 60days, the deposit shall be deemed forfeited
* For instalment cases, the member shall pay as per the agreed payment schedule. Should there be no payment update for more than 2 months and without notice or response from the member, the membership shall be terminated. Upon such termination, there is no refund for any payment/deposit made. - Use of the Winner Membership Program
* Membership cards will not be issued and the registered phone number of the Member is required for membership verification during events and/or purchase of products/services from the Company.
* The Company will only provide the Program’s service and content to the Member, transfer of benefits and membership is not permitted, unless it is expressed and clearly stated otherwise.
* The Company reserves the right to waive, add or amend the Program terms and conditions(“T&C”) without prior notice. Any new or amended T&C will supersede the existing T&C. - Program Termination
* Members of the Program may terminate/quit the Program at any time but refunds will not be provided. Program termination should be done by notification to us via email to lelaoshi9@gmail.com or by filling in and returning the Program Termination Form from the Company. Membership of the Program will be terminated within 30days upon receipt of any notice.
* The Company may at its sole and absolute discretion terminates, suspend or cancel a Membership at any time with or without prior notice and with or without cause. - Member’s benefit
* Lifetime Membership – no renewal is needed
* Exclusive Community – You will be invited to join the Program’s telegram community group upon completing the registration process. You will receive regular updates through the community’s telegram group on events schedule and special promotions.
* Exclusive Fengshui Tips in community group – In the community telegram group, you will receive monthly fengshui tips on fengshui solution, tips on promoting prosperity and summary of annual fengshui layout after the annual FengShui Seminar.
* Free admission to online FengShui Seminar – You will have free admission to the annual FengShui Seminar held by the Company (online version).
* Members’ Specials – Enjoy exclusive discount on selected products/service provided by the Company.
* Other Benefits & Special Privillages – you will be entitled to join all regular events, such as monthly Members meeting with AMA(Ask Me Anything) session with Teacher Le, and special events under the Program, including but not limited to courses/seminars/talks by invited guest speaker(s). - Program Content

* Free Basic Life Chart Analysis x1 session – transferable to third party
* Free Blue Child courses (2 courses) to member who register sucessfully into the Program - Company Responsibility
* The Company is committed to providing Members in the Program with a positive experience.
* Company shall conduct courses specified under the Program Content and fulfil the services listed under the Program - Members’ Responsibility
* Members accept and agree that the Member is 100% responsible for the progress and results from the Program. The Company makes no representations, warranties or guarantees verbally or in writing. Members understand that because the nature of the program and extend, the results experiences by each member may significantly vary. Member agrees that the Company is not liable or responsible for any actions or inactions, or for any direct or indirect result of any courses or services provided by the Company.
* Members shall not do anything or permit anything to be done that will injure or compromise the integrity, goodwill and reputation of the Company.
* The Member is not allowed to charge nor collect any amount of fee from any third party for any Life Chart Analysis service without consent from the Company.
* The Member is not allowed to make any derivative work or commercial use of the Program without consent from the Company. The Company hereby reserves the right to bring suits, claims, and actions for any and all causes of action arising from this Terms and Conditions. - Intellectual Property
* Nothing in the Program shall be construed as granting the Member any title, interest or right in, of or to any Intellectual Property of the Company or embodied in or in connection with the Program. All goodwill generated from the use of the Program or any Intellectual Property of the Company will inure to the Company’s exclusive benefit.
* “Intellectual Property” means any Know-how, patent, trademark, service mark, trade name, trade secret, copyright, design print or other industrial or intellectual property right subsisting in any country, whether or not registered or capable of registration and all associated rights of registration relating to any of the aforesaid, whether presently existing or created in the future.
* “Know-how” means any confidential and proprietary industrial, commercial and technical information, including, but not limited to, discoveries, inventions, innovations, techniques, methods, procedures, processes, unpatentable processes, recipes, formulae, improvements, drawings, documents, materials, research and development information, financial, marketing and business data, pricing and cost information, business and marketing plans, and customer and supplier lists.
* The rights and obligations under this section shall survive termination of the Program. - Confidentiality
* The Company respects Members’ privacy and insists that Members respects the Company and other Members of the Program.
* “Confidential Information” means the content of this Agreement, all discussions in connection therewith and all information which may reasonably be supposed to be confidential, including, but not limited to, any information shared by Members of the Program or any representative of the Company, Members’ contact and information, any of the Parties’ customer information, business plans, marketing plan, price information, Know-how and trade secrets.
* The Company and Members will keep Confidential Information in strictest confidence. Both Parties will not disclose Confidential Information to any third party.
* Parties agree not to disclose, reveal or make use of any Confidential Information or any transactions during discussion or training or otherwise. Member agrees not to use such Confidential Information in any manner other than in discussion with other Members during Program. - Data Protection and Privacy Policy
* When applying for Membership, you are required to provide certain personal information, including your full name as per your MyKad or any other personal identification, address, and contact details. This information will be held strictly confidential and will not be shared with any third party without your consent.
* The Company is committed to maintaining the security of your personal information in accordance with the requirements of the Personal Data Protection Act 2010 and will take all necessary reasonable steps to ensure that your personal data is secured against unauthorized access, loss, disclosure or destruction.
* The Data Protection and Privacy Policy will apply whenever you provide the Company with your personal information unless it is required by law or any regulatory authority to disclose or to share your personal information. - General
* The Membership remains the property of the Company at all times.
* The Company may at its discretion at any time, terminate the Membership by giving thirty (30) calendar day’s notice.
* The Company (including its successors, assigns, officers, directors, shareholders, agents, affiliates and subsidiaries) shall not be liable to you or any third party authorized by or claiming through you for any loss, damage, cost, expenses, actions, suits, claims and demand whatsoever, whether direct, indirect, special or consequential, of loss of business, revenue of profits or of any nature suffered by you or any person for any loss, damage or injury caused or suffered by a person arising from the usage of the Membership.
The Company shall hold no liability if a Membership application is rejected for any reason whatsoever.
* The Terms and Condition are governed by and hall be construed in accordance with laws of Malaysia. You hereby expressly submit to the exclusive jurisdiction of the courts in Malaysia.
* If any of the provisions herein contained should be invalid, illegal or unenforceable under any applicable law, the legality and enforceability of the remaining provisions should not be affected.
* The Company has the final authority as to the interpretation of the Terms and Conditions and as to any other questions or disputes regarding the Membership.
* the Company reserves the right to amend these Terms and Conditions from time to time when it is reasonably considered necessary to do so. Reasonable notice shall be posted on the Company’s official website as a notification of the said amendment(s). Your continued usage of the Membership after any amendment(s) to the Terms and Conditions shall constitute your acceptance to the such amendment(s).
* The Company shall not be liable for any loss or inconvenient faced by you as a result of the amendment(s) of these Terms and Conditions.
* All communications and /or correspondences by the Company, is either by way of notification though the Company’s official website and/or advertisements and/or any other media deemed fit. Any such notification shall immediately supersede the previous communication and/or correspondence with regard to the same matter, unless it is expressed and clearly stated otherwise.
* Any notice to be given pursuant to these terms and conditions shall be sufficiently sent to you by way of notification and/or publication on the Company’s official website.
* Any communications to be given by you to the Company in relation to these Terms and Conditions can be made by sending it in writing via email to lelaoshi9@gmail.com
